Pool testing to ensure proper sanitation is absolutely vital in minimizing disease risk. All water activity venues must be tested - not only public wading and swimming pools, but also hot tubs, medical treatment pools, ceremonial pools, spas, whirlpools, and water parks. Evaluating these facilities for environmental health compliance includes checking the circulation, filtration, and water treatment records; the ancillary safety equipment; diving boards; ladders; and, most importantly, the quality of the water. Microbiological sampling often follows a negative test for residual disinfecting agents such as chlorine or bromine. Additional evaluations related to water cleanliness need to be performed, including evaluations of pH, total alkalinity, and chlorine stabilizer. It goes without saying that for a pool to be safe for bathing, water chemistry, temperature, and turbidity, as well as mechanical systems and deck equipment, must be properly maintained. Balancing the chemical parameters is also important; factors such as water hardness can affect the life expectancy of pool equipment such as ladders (through corrosion or scaling), and decaying equipment can, in turn, affect safety. We have found several portable test kits on the market that allow for the testing of the basic parameters such as pH and residual disinfectant loading. More complete test kits measure pH, disinfectant residuals (chlorine and bromine), total alkalinity, calcium hardness, acid demand, base demand, and cyanuric acid. These expanded kits have a definite advantage in monitoring overall water quality. Test kits use one of two methods to assess residual chlorine levels in swimming pool waters: the orthotolidine (OT) method or the N,N-diethyl-P-phenylenediamine (DPD) method. With the OT method, the chlorine residual is indicated by a yellow color, but the shade of yellow that indicates free chlorine is very fleeting, and the end point is a darker color that represents total (free and spent) chlorine. Most people cannot distinguish free chlorine with this test. Also, OT is a carcinogen. DPD tests indicate chlorine with a characteristic pink color and more reliably distinguish free chlorine (the active sanitizer) from total chlorine (which includes spent sanitizer). For this reason, most health codes specify DPD testing.

Our panel of industry experts covered the gamut of topics in our seventh annual legal roundtable. As the economy dips, firms are adjusting to meet the needs of industry, while also focusing on ways to better serve the large corporate client. The panel also discussed recruiting and mentoring trends for young associates, supporting the states startup businesses and the changing role of technology in the legal field.
They argue that, if marijuana, cocaine, heroin, and other drugs were legalized, several positive things would probably occur: (1) drug prices would fall; (2) users would obtain their drugs at low, government-regulated prices, and they would no longer be forced to resort to crime in order to support their habits, (3) levels of drug-related crime, and particularly violent crime, would significantly decline, resulting in less crowded courts, jails, and prisons (this would allow law-enforcement personnel to focus their energies on the “real criminals” in society); and the drug production, distribution, and sale would no longer be controlled by organized crime, and thus such criminal syndicates as the Colombian cocaine “cartels,” the Jamaican “posses,” and the various “mafias” around the country and the world would be decapitalized, and the violence associated with drug distribution rivalries would be eliminated. By contrast, the anti-legalization camp argues that violent crime would not necessarily decline in a legalized drug market. In fact, there are three reasons why it might actually increase. First, removing the criminal sanctions against the possession and distribution of illegal drugs would make them more available and attractive and, hence, would create large numbers of new users. Second, an increase in use would lead to a greater number of dysfunctional addicts who could not support themselves, their habits, or their lifestyles through legitimate means. Hence crime would be their only alternative. Third, more users would mean more of the violence associated with the ingestion of drugs. These divergent points of view tend to persist because the relationships between drugs and crime are quite complex and because the possible outcomes of a legalized drug market are based primarily on speculation. However, it is possible, from a careful review of the existing empirical literature on drugs and violence, to make some educated inferences.

H2Diesel Holdings Inc. has entered into a Test Burn Agreement with Mirant Energy Trading LLC, a subsidiary of Mirant Corp., to demonstrate its proprietary biofuel technology in utility scale power generation applications. The test program will include the evaluation of both technical and environmental performance characteristics of H2Diesels biofuel. CARTERET, N.J. — Propelled by a gain on the sale of real estate, Pathmark Stores Inc. saw second quarter net income climb 77.1%. Backing out onetime items, however, profits fell sharply. The company recorded net income of $6.2 million for the 13 weeks ended August 2, reflecting the $7.2 million after-tax gain as well as a $1.8 million after-tax charge related to a labor buyout program. Factoring out those unusual items, earnings would have plunged 77% to $800,000. During the second quarter we were pleased to see continued gains in sales and market share, which reflect improvements in our store-level execution and marketing programs, says chief executive officer Eileen Scott. On the expense side we are also beginning to see the benefits from our previously announced store labor buyouts and headcount reduction program in our corporate offices. However, we experienced higher costs associated with medical, pension and general liability compared with the second quarter last year, which impacted our results.

Koppel of Gordon, Feinblatt Rothman, Hoffberger Hollander LLC in Baltimore.The federal law, which went into effect in October, aimed to reduce abuse of the bankruptcy system by those who could have paid their debts. Under the measure, consumers must get credit counseling before filing for bankruptcy and have their ability to pay debts investigated.Backers of the study said they wanted to counter the notion that the law was working. Anecdotally, they acknowledged, the number of bankruptcy filings had dropped, though official case counts since the change are not yet available from the Administrative Office of the U.S. Courts. But researchers attributed the decrease to a surge in filings before the deadline last year and a growing notion among consumers that bankruptcy is no longer an option.The report looked at 61,355 consumers who had visited six credit-counseling firms since the law went into effect. The firms reported that 97 percent of those clients were unable to repay any of their debts, and that four out of five would-be filers found themselves in troubled financial circumstances because of events beyond their control.Study backers also said they wanted to dispel the idea that filers were merely deadbeats living beyond their means. One East Coast credit counselor said consumers seeking pre- bankruptcy counseling at her firm included an elderly Midwestern woman who had moved into her kitchen because she couldnt pay the heating bill, and a Florida single mother and four sons, including one with cancer These are real people. For most of them, they are at their worst financial condition in their lives, said Leslie E. Linfield, executive director of the Institute for Financial Literacy, a nonprofit credit counseling business based in Portland, Maine.The law change, which added work for bankruptcy attorneys, has driven up legal fees by 50 percent, the group said. Consumers also face new costs from the mandatory education courses. Credit- counseling courses needed before filing cost an average of $50. A second financial education course required before exiting bankruptcy can cost another $25 to $50, study backers said.They have done nothing more than put more hurdles in the path of those who are already on their back, said Brad Botes, executive director of the National Association of Consumer Bankruptcy Attorneys, during a conference call. Botes predicted the number of filings would soon return to the levels seen before the change.Congress got bankruptcy reform wrong. Dead wrong, he added.
Attorneys and court officials are working through a mountain of bankruptcy petitions after the onset of a new law-triggered a mad scramble of last-minute filing. Thousands of people filed for protection at the bankruptcy court for the Middle District of Pennsylvania in Harrisburg in the month preceding Oct. 17, when the new law toughened the rules for bankruptcy filings. Between Sept. 16 and Oct. 16, the court received 3,664 bankruptcy petitions, according to electronic records. In the same period in 2004, the court received 642 filings.

Real estate practice is a broad and widely defined area of the law. In a pristine sense it deals with the esoteric subject of real property law and titles. In practice the subject matter handled by real property lawyers is much broader. Many of the areas of law within real estate practice are areas of specialty themselves. Real estate lawyers examine and evaluate real property titles, handle real estate sales, purchases and other transactions, foreclose mortgages, represent developers and contractors in drafting and negotiating development and construction agreements, handle real estate financing, structure and draft the governing documents for planned developments such as condominiums, serve as counsel to community and condominium associations, draft and negotiate leases, litigate title, boundary, and other land disputes, and advise clients respecting zoning and land: use matters. The examination of real estate titles requires knowledge of corporations and other forms of business organization, wills, trusts and estates, and a practitioner handling transactions must understand contractual, business, and tax subjects as well. The subjects that are tested on the certification exam attest to this diversity. They are title issues; real estate finance; environmental and land use; condominiums and homeowner associations; landlord tenant; closings; sellers, buyers, brokers, and title insurers; real property litigation; taxation of entities and other tax issues; and ethics. Some hold an impression that at least some aspects of the real estate practice are not challenging, that the practice is increasingly title company, form, and paralegal driven, and that when business is light any lawyer with a good paralegal can Ado real estate closings. This impression is not accurate. As with any area of practice, successfully representing clients in real estate matters requires knowledge, skill, and experience. The diversity in real estate practice may mean that no one lawyer can be an expert in each practice area encompassing the modern real property practice or that are tested by the certification program. That, however, is not a reason to not seek certification. The committee recognizes that few lawyers are likely to possess specific and detailed expertise in each of the many subjects that fall within the scope of real estate.

In this virtual market of unseen participants and products, buyers and sellers face the risks of repudiation, as the counter party may deny the agreement after the fact. Buyers assume risks associated with lack of seller integrity and asymmetric information about the particular product, as the buyer is typically required to send payment before the seller ships the product. In addition, for many eBay transactions, the cost of enforcing a contract is high relative to the transactions value, resulting in a practical absence of legal enforcement. (2) By providing a history of trade execution information, eBay benefits market participants by reducing information asymmetries while achieving substantial transaction cost economies. Market participants relate personal experiences, which eBay uses to calculate a numerical reputation measure for each user. Market participants, in turn, can use this reputation measure to assess counter party risk and adjust bidding behavior accordingly.

On Friday, the Cougars (2-12-1) ended their 12-game losing streak by knocking off the Boulder Rapids Reserves 2-1 in overtime. “I have a whole new appreciation for winning now,” BYU coach Chris Watkins said. “It is neat to be rewarded with three points at the end of the day. “Clearly we are getting better. A CAMBRIDGE University graduate has been trampled to death by an elephant while trying to photograph it during an overland expedition from Britain to South Africa. Second Lieutenant Edward Harrison, 28, a member of the universitys Officer Training Corps, is believed to have woken at dawn and wandered off on his own to photograph wild animals at the Masai Mara game reserve in Kenya on Sunday morning. Fellow travellers were woken by the sound of the elephant and later discovered his body outside the secure compound of the Sopa safari lodge.
